Underground Petroleum Storage
Systems (UPSS)

If you own or manage an Underground Petroleum Storage System (Underground Storage Tank(s) associated line(s) and bowser(s)) in NSW you will have to comply from June 1, 2008 with the Protection of the Environment Operations (Underground Petroleum Storage Systems) regulation 2008 requiring:

  1. For new UPSS which received planning approval after June 1, 2008:
    • a system for detecting and monitoring leaks
    • groundwater monitoring wells at sensitive locations and a program to test them
    • an Environment Protection Plan for the facility
    • Systems in place for record keeping, reporting of leaks and notifying the local council when a UPSS is decommissioned.

  2. For existing UPSS there is a transition period of up to 12 months to implement an Environment Protection Plan plus procedures for monitoring and detecting leaks; and up to 36 months ( 1June 2011) to install groundwater monitoring wells.

  3. For existing UPSS which require significant modifications – replacement of more than half the tanks or work which requires a Development Consent must meet the mandatory requirements for a new a new UPSS.
Exemptions are expected to mainly be applied to the operations of old UPSS, where the operator/owners are able to demonstrate that the UPSS site is not contaminated and that appropriate systems are in place to ensure any leak or spill from the system will not pose health or environmental risks. Exemptions may also be granted, for new systems which can similarly demonstrate an absence of contamination and that no environmental or health risks will be posed from any leak or spill from the system.
